			<content:encoded><![CDATA[<p>As our parents age and making decisions becomes more difficult, someone becoming a Guardian of their elderly parent rather than continuing as a Power of Attorney may become necessary and the best option to keep your parent(s) safe. But what is Guardianship and what do you need to know about it?<br />
Following is a definition of guardianship and the questions you may want to get answered and be aware of before you pursue guardianship.</p>
<p>To get find answers to the guardianship questions, you can ask an attorney, see if your State&#8217;s Department of Health and Human Services has a booklet, check your local Probate Court to see if they can answer some of the questions or have a booklet, search the web, get a free report that answers the questions presented here at The Practical Expert or speak with a social worker at any hospital or nursing home.</p>
<p><strong>Definition of Guardianship: </strong><br />
(Appointee refers to the person applying for Guardianship, or who is a court-appointed appointed Guardian; Ward refers to the person who is or would be under Guardianship.)</p>
<p>Guardianship is a legal mechanism, usually done through Probate Court, which appoints a person, persons or public entity, to make decisions on behalf of another person. The Appointee must demonstrate that the Ward is unable to make decisions responsibly or independently. A Guardian has the power to make decisions for the Ward, even if they are decisions the Ward does not like. Control over where a person lives, how money is spent, what medical care is received, etc., are the responsibility of the Guardian. There are several different versions of Guardianship, including full Guardianship, which is the most restrictive, and limited Guardianship, which spells out specific areas that a Guardian will control. There is also Co-Guardianship, Limited-Time Guardianship, Medical Guardianship, Residential Guardianship and Temporary Guardianship. These will be discussed later.</p>
<p>The decision to pursue Guardianship is a very serious one, as it significantly affects a person&#8217;s individual rights and freedoms. Yet Guardianship remains one of the best ways to protect those who without it could be abused and/or victimized.</p>
<p>At the same time that you pursue Guardianship, you may wish to pursue Conservatorship, which is legal control of financial matters. You can apply for both or just one of these legal appointments. Social Security is not covered by Conservatorship, but rather must be obtained directly from the Social Security Administration.</p>

<p>When you fully understand the benefits and drawbacks of guardianship, then you need to have discussions with your parents and family members. If you apply for guardianship, it is fairly simple and the paperwork is not difficult. Cost for obtaining guardianship papers, is less than $50 and is done through your local Probate Court. You or your Attorney complete the forms and then return them to the Court and, usually, a small filing fee paid. Then a hearing will be scheduled.</p>
<p>Guardianship isn&#8217;t to be taken lightly but at times, it is the safest way to protect your loved one. If you become a guardian of a person, please respect their wishes and need for independence as much and as far as possible. Everyone deserves respect, dignity and the right to be heard.<br />

<p>When parents divorce, they have to decide where the child will live. They also have to make decisions regarding the upbringing of the child. Child custody laws describe the rights and responsibilities of parents for their child.</p>
<p>Physical custody will generally describe who the child will live with. The parent may agree on physical custody, or the court may order a parenting plan. In general, a child will live primarily with one parent. The parent would be considered as sole physical custody. The other parent would be non-custodial parent. If the child lives equally with both parents, the parents are said to have joint physical custody.</p>
<p>Legal custody will generally describe the decision making on upbringing of the child. In most cases, both parents will have joint legal custody of the child. However, the court awards sole custody to one of the parents in some cases.</p>
<p>Legal custody is very different from physical custody. For instance, a parent with legal custody has the right to decide on the child’s medical care, dental care, education, and religion. However, the child may or may not live with that parent. It is important for the parent to understand the difference before making a request for legal custody.</p>
<p>Legal battles over child custody can be long and expensive. Both parents will need to pay very expensive legal fees to family courts and family law attorneys. If it is possible, parents should come to an agreement on physical and legal custody of the child without the family courts.</p></div>

<p>A divorce is one of the worst things that can happen to a family. It can tear families apart, and leave everyone feeling miserable. Most couples try as hard as they can to save their marriage before deciding to make divorce their final step. Legal separation is an option that married couples can turn to when they have major problems in their relationships.</p>
<p>It is the act of living separate lives without divorcing. It is an opportunity that gives each partner time to decide what they really want, to work though issues, and to try to patch up their problems. Legal separation can sometimes fix relationships, and it may also reinforce the need for divorce.</p>
<p>A lot of issues may come into play with a legal separation. You may be able to pay your taxes separately, which can be an asset, and you may have to worry about child custody issues as well. You may also have to worry about who will make the house payment, who will drive what car, and who will care for any family pets. It is a good idea to get the advice and assistance of a good lawyer if you decide to enter into legal separation.</p>
<p>This will help you in figuring out what you need to do, and what your rights are. You may try to handle this option on your own, but beware of making mistakes. Any mistake you make during legal separation can affect the outcome of your divorce, and have an impact on child custody issues.</p>

Since laws will vary from one state to another, you should be careful when you are going through this information. You should also keep in mind that not all information you find online will be accurate.</p>
<p>If you try this option as a last resort to save your marriage, don’t feel bad about it. There is nothing wrong with doing what you think is best for your family and for yourself. Legal separation can save your marriage, or at the very least, make you more comfortable with your decision to end your marriage.</p></div>

If unable to bear the retainer charges, the court can make the spouse bear the retainer charges when the court is requested for counsel fee pedente lite! Pedente lite is a court order for taking financial care of a low income spouse while court proceedings are ongoing.</p>

<p><strong>2. The Bar Association</strong> – A local or state bar association can be a wonderful resource as they will tell you which of their members specialize in Family Law. Get a hold of that list, contact the attorneys directly, and interview them. Typically, your first visit is free so that you can learn what the family law attorney will do for you, their fee structure, and much more.</p>
<p><strong>3. Legal Aid Societies</strong> – Your state or county should have a legal aid society. If you find that the cost of retaining counsel is prohibitive, consider contacting your local chapter for help. Some will offer their services for free or “pro bono.” Some attorneys will charge you based on a sliding scale, taking into consideration your ability to repay.
